Dissolve Or Organise

Syria’s Brotherhood argues in public about dissolving itself as a 1980 death-penalty statute sits unrepealed

The organisation’s own site says calls to dissolve the Syrian chapter grew louder after its Shura Council statement of 27 September. Whether Law 49 of 1980 still makes membership a capital offence is unresolved.

Ikhwansyria.com, the Syrian Brotherhood’s own portal, carries a statement from the Shura Council of the Muslim Brotherhood in Syria, fifth ordinary session, 2026, and separately an article dated around 1 October headed, in translation, “The right to organise is a guarantee for everyone: why should the Muslim Brotherhood in Syria not be dissolved?” The site states that after the Shura statement of 27 September 2026, voices calling for the group’s dissolution grew louder. On 2 October the Egyptian Brotherhood-aligned portal fj-p.com characterised that statement as asserting a right to political activity as a societal component. This is primary material in the strict sense: reliable as to what the organisation says about itself, and worthless as evidence of anything beyond that. The full Arabic text of the 27 September statement and the name of the current General Supervisor were not retrievable.

The legal backdrop is genuinely unsettled. Ynetnews published an opinion-analysis on 15 October arguing Syria may repeal Law 49 of 1980, which makes Brotherhood membership a capital offence. Its one substantive point is worth carrying as a question rather than a finding: the January 2025 Victory Conference declaration suspended exceptional laws and dissolved Baath Party structures, and it is unresolved whether that already covered this statute or whether formal legislative repeal is still required. Ynet is an Israeli outlet, the piece is a column, and nothing in it establishes that a repeal has been scheduled or announced. No statement from the Syrian justice ministry or People’s Assembly surfaced in the search window.

Assessment: Read the two clocks against each other. Washington has built a chapter-by-chapter machine — Executive Order 14362 signed 24 November 2025, three chapters designated on 13 January 2026 in what Treasury called the first actions of an ongoing, sustained effort, the Sudanese Brotherhood designated SDGT on 16 March by Secretary Rubio — and a chapter that dissolves itself is a harder target than one that persists as a named body. That is the incentive to watch, not piety about reform. The counter-pressure is that in Damascus legalisation may be available for the first time since 1980, and dissolution forfeits it. Both the dissolution debate and the Law 49 question currently rest on one partisan outlet and the group’s own website.
